Oxford MS Business License: Privilege License, Alcohol Permit Checklist and Cannabis Rules

If you are opening a business in Oxford, the first thing to understand is that Mississippi does not issue a general business license. The license that lets you open in Oxford is the city privilege license from the City Clerk. Depending on what you sell, you may also need alcohol, food, transient vendor or cannabis approvals on top of it. This guide puts those pieces in the order you should tackle them, lists what to gather, and flags the figures you still need to confirm.

This article is informational only. It is not legal or tax advice. City ordinances and fees change, so confirm every figure with the agency before you budget. For alcohol, cannabis or entity-structure decisions, talk with a qualified attorney or CPA first.

What Mississippi Does and Does Not License

Three state filings get confused with licenses. None of them is an Oxford business license.

  • Entity formation. An LLC files a Certificate of Formation (Form F0100) with the Mississippi Secretary of State for a $50 filing fee. This registers your company. It is not a license.
  • Fictitious (assumed) business name. If you trade under a name other than your legal entity name, file a Fictitious Business Name Registration (Form F0070) with the Secretary of State for $25. It is filed with the state, not the county.
  • Sales tax permit. If you sell taxable goods, register with the Department of Revenue. The permit is a tax registration with no fee, although a bond may be required for applicants with no permanent Mississippi location.

Cities, towns and villages issue their own privilege licenses under Miss. Code 27-17. Counties license only businesses outside municipal limits. If your Oxford location is inside city limits, the City of Oxford is the agency that issues your local license.

Materials to Gather Before You Call

  • Your exact legal entity name and Secretary of State filing number, which you can check on the Mississippi business search
  • Your federal EIN, and your Mississippi sales tax permit number if you sell taxable goods
  • The street address of the Oxford location, plus the property owner's name and a copy of the lease or deed reference
  • Names, addresses and contact details for every owner and manager
  • A written description of what you sell or do, including any food, alcohol or product categories
  • A registered agent with a Mississippi street address. For an LLC, the agent must meet the rules in Miss. Code 79-29-113.
  • A written list of questions for the City Clerk and Planning office

Step by Step: The Order to Work In

  1. Form the legal entity. Choose your structure, then file online through the Secretary of State online filing portal. The LLC filing fee is $50. The name must contain "limited liability company," "L.L.C." or "LLC," and it must be distinguishable from names already on the state records. Corporations file Articles of Incorporation (Form F0001) for the same $50 fee.
  2. Register a fictitious name if you need one. File Form F0070 for $25 with the Secretary of State. Banks may ask for this filing before they open an account under the trade name, so check with your bank and file it early.
  3. Register for sales tax before your first taxable sale. Apply through the Department of Revenue sales tax registration page. The state rate is 7%. Local city levies apply only in Jackson and Tupelo, and there is no county add-on, so Oxford sellers charge the 7% state rate.
  4. Call the City Clerk for the privilege license. The Oxford City Clerk issues privilege licenses from 107 Courthouse Square, 662-236-1310. The general fee and renewal date are not published online, so you must ask. Ask which license class fits your business, the current fee, the renewal date, the application form, and whether a zoning or inspection sign-off must come first.
  5. Clear zoning and land use before you sign a lease. Confirm that your intended use is allowed at that exact address. Ask the City Clerk or the Planning office about it. Ask them for the current short-term rental (STR) rules as well, because this guide does not summarize them.
  6. Add industry permits. Alcohol, food, transient vendor and cannabis each have their own track, covered in the sections below.
  7. Calendar your recurring filings. The LLC annual report (Form F0108) is due April 15 each year, has no fee, and must be filed online. Corporations file their annual report (Form F0008) for $25, due April 15 for profit corporations. Add the City Clerk's privilege license renewal date once you have it, and your sales tax filing schedule.

Alcohol Permit Checklist

Alcohol is the most layered part of an Oxford license. Work through each track in order, because later steps depend on earlier ones.

Beer or Light Wine Retail Sales

  • Obtain the state retailer beer permit. Light wine sales are handled on the same retailer track.
  • Name a compliance representative before you apply.
  • Obtain an MSDH food permit where it applies to your operation. Confirm applicability with the Mississippi State Department of Health before you sign a lease for a food-service space.

On-Premises Sales (Bars and Restaurants Serving Drinks)

  • Obtain the state on-premises permit.
  • Install cameras with digital video recording (Sec. 14-100.5).
  • Install age-verification devices (Sec. 14-100.6).
  • Set up an employee record system (Sec. 14-101).
  • Prepare a safety plan (Sec. 14-102) and have the city review it before you open.

Confirm the current wording of each section with the City Clerk before you buy equipment or finish a build-out. Equipment bought to the wrong spec is a costly mistake to unwind.

Transient Vendor Licenses

If you sell from a temporary or itinerant location rather than a fixed Oxford storefront, ask the City Clerk whether a transient vendor license applies. The City Clerk form lists $250 for a new license and $25 for renewal. Use the Clerk's current form for the exact requirements.

Cannabis Rules

Oxford's 2022 ordinance governs medical cannabis businesses. Plan for four steps in this order:

  1. Obtain the city business privilege license.
  2. Obtain land-use approval for the specific site.
  3. Obtain the city cannabis business license. The 2022 ordinance figures are $1,500 one-time and $1,000 annual. Ask the Clerk for current amounts before you budget, because these are the figures to verify, not settled numbers.
  4. Obtain the state license. The city steps do not replace it.

The site must sit at least 1,000 feet from a church, school or daycare. Ask the Clerk how that distance is measured, and check it before you sign a lease. A single address can fail the buffer even when the building looks suitable.

Short-Term Rentals

If you plan to rent a property by the night, ask the City Clerk or the Planning office for the current STR rules before you buy or list the property. The rules govern whether the use is allowed and what registration applies. Do not assume a privilege license alone covers an STR.

What to Expect

These are the outcomes you can reasonably plan around. They are not guarantees, and city timing can vary.

  • Secretary of State filings. Most documents paid for online are approved and filed immediately. Filings that need staff review are normally returned filed within 24 hours of submission. Paper filings take significantly longer.
  • City privilege license. The processing time is not published, so ask the Clerk for it when you call. Plan for a gap between your signed lease and your first open day.
  • Alcohol and cannabis. These tracks involve several agencies and inspections. Expect them to take longer than the entity and tax steps, and do not commit to a launch date until each permit is in hand.

Tax Notes for Your Entity Choice

An LLC taxed as a partnership does not pay the Mississippi franchise tax. A corporation does. For tax year 2026, the franchise tax is $0.50 per $1,000 of capital above $100,000, with a $25 minimum, and it is repealed effective January 1, 2028. Corporate income tax is 0% on the first $5,000 of taxable income, 4% on the next $5,000 and 5% above $10,000. Mississippi also has no state minimum wage law, so the federal minimum wage applies to your Oxford employees. Choose your structure with a CPA, not from this summary.

Common Mistakes to Avoid

  • Paying for a state business license. Mississippi does not issue one. The $50 entity filing and the $25 fictitious name filing are registrations, not licenses.
  • Filing a fictitious name with the county. It goes to the Secretary of State.
  • Looking to the county for an Oxford license. Counties license only businesses outside municipal limits.
  • Signing a lease before the land-use and distance checks. This is the costliest mistake in Oxford, especially for alcohol and cannabis.
  • Buying equipment before reading the code sections. Cameras, age-verification devices and safety plans must match the current text.
  • Budgeting from an old or unconfirmed figure. Use the fee snapshot above only for amounts that are confirmed, and confirm the rest with the named agency.

Where to Get Help

The Mississippi Small Business Development Center Network is hosted by the University of Mississippi and has 19 locations statewide. In the Oxford area, the Ole Miss and Lafayette County SBDC offices and the RISE Center offer business help. Bring your question list from step four, and ask the Clerk to confirm each figure in writing.

Bottom Line

In Oxford, your local license comes from the City Clerk, your state filings come from the Secretary of State and Department of Revenue, and your alcohol or cannabis track adds its own sequence. Confirm the privilege license fee, renewal date and processing time with the City Clerk at 662-236-1310 before you commit to a lease or launch date. For complex alcohol, cannabis or entity decisions, work with a qualified attorney or CPA.
